Quick answer
Nevada has its own written-request rules. Nevada Administrative Code (NAC) 615.105 generally allows sixty days after notice of the decision to request a hearing, and thirty days to request the specified alternate dispute-resolution or mediation route. Informal discussion is also allowed.
What to do
Save the decision and record when you received notice.
Identify the disputed decision and requested correction.
Direct a written hearing request to the Administrator or designee using current agency instructions.
Ask Client Assistance Program (CAP) for help and confirm receipt; keep a copy.
Follow the hearing officer’s orders for statements, exhibits, and witnesses.
Limits and deadlines
NAC 615.105 permits a late hearing request for good cause if allowed; do not rely on an extension without a determination. Informal discussion is not an automatic deadline extension.
NAC 615.115 addresses the hearing’s timing and continuance. NAC 615.165 points to NRS 233B.130 for judicial-review timing. This guide does not calculate or give court-filing instructions. Obtain prompt help after a decision.
For review covered by 34 CFR 361.57(b)(4), services already being provided—including assessment and individualized plan for employment (IPE) development—may not be suspended, reduced, or terminated pending resolution, subject to the stated exceptions for an individual’s request or evidence of misrepresentation, fraud, collusion, or criminal conduct. This protection does not automatically approve a newly requested service.
