Quick answer
Comparable services and benefits are qualifying supports available from other sources that meet the relevant need at the time needed. Federal rules contain exempt services and timing protections. Merit-based awards and scholarships are excluded from the federal definition.
What to do
List each possible outside source, amount, restrictions, and availability date.
Ask which rule makes it comparable for the particular service.
Document any gap between when support is needed and when it becomes available.
Ask for a written calculation showing how each source affects vocational rehabilitation (VR) payment.
Limits and deadlines
Under 34 CFR 361.53, assessment and several other service categories are exempt from the availability determination. Delay protections depend on the rule’s specific conditions.
Interagency reimbursement provisions concern payment between agencies. They do not automatically establish a consumer’s right to repayment for an unapproved expense.
Background, examples & sources
Documents to gather
- Award letters with conditions
- School account and cost breakdown
- Availability dates and service-start deadline
- Agency’s calculation
Fictional example
A grant is confirmed but will not be available before required training begins. The learner documents the dates and asks how the timing provisions apply; the request does not itself authorize spending.
